Form 3207 physical location
Per the Form 3207 instructions, the facility must have a license for each physical location where the facility provides residential or outpatient services. An applicant seeking a CDTF license must submit a completed application, license fee, and other applicable documents to HHSC. The Health Facility Licensing Unit will not process an application until after HHSC Accounts Receivable receives and posts the license fee. An application under Texas Health and Safety Code Chapter 464 and Texas Administrative Code Title 26 Chapter 564 is for licensure as a CDTF only, and issuance of a license under those provisions does not satisfy any other applicable requirement for licensure or other form of authorization.
Six-month application clock
In accordance with 26 TAC Section 564.403(f), HHSC maintains an application for six months after the date HHSC receives the application. If an applicant has not demonstrated compliance with all applicable requirements during that time, HHSC denies the application. A person may not offer or purport to offer chemical dependency treatment without a license issued under this subchapter, unless the person is exempted under Subchapter C or is working for or providing counseling with a program exempted under Subchapter C.

A program exempted under Subchapter C may not provide medical care, medical detoxification, or medical withdrawal services. After an investigation has been initiated by the Commission, or a facility's license has been revoked or surrendered, a facility is not eligible to receive a faith-based exemption under Subchapter O of this title (relating to Faith-Based Chemical Dependency Programs) until two years have elapsed.
